CLIFFS TRAVEL is an online service for travel, entertainment and related services (the “Service”) operated by Custom Travel Solutions (“Cliffs Travel”, “we”, “us”, or “our”). This Service is accessible through a personal computer, mobile device, or other access device at the Cliffs Travel domain using a communications connection (e.g., Internet service provider or wireless network).

As part of the Service, you will be provided with services that may include, without limitation, access to travel opportunities, savings, lifestyle benefits, and other related features which are subject to the terms hereof. Cliffs Travel may, in its sole discretion, discontinue or alter any aspect of the Service, including, but not limited to: (i) restricting the time of availability, (ii) restricting the availability and/or scope of the Service for certain platforms, (iii) restricting the amount of use permitted, or (iv) restricting or terminating any User’s right to use all or part of the Service, at any time, at Cliffs Travel’s sole discretion and without prior notice or liability.

You are responsible for all charges associated with connecting to the Service, including internet or mobile data usage. You are also responsible for obtaining or providing all equipment necessary to access the Service. You certify that you are an individual (i.e., not a corporation).

The Service contains material that is derived in whole or in part from material supplied and owned by Cliffs Travel and/or their suppliers and licensors. Such material is protected by copyright, trademark, and other applicable laws. You may not modify, copy, reproduce, republish, upload, post, transmit, publicly display, prepare derivative works based on, or distribute in any way any part of the Service or any material from the Service, including but not limited to code and software. You may, however, subject to your compliance with this Agreement, and solely for as long as you are permitted to access and use the Service, download certain material for your personal, non-commercial use only, provided you keep intact all copyright and proprietary notices.

Password

Should you select a password that allows you to access the Service, you will be solely responsible for maintaining the confidentiality of the password and your account information, and will be fully responsible for all activities that occur under your account. You agree that you will immediately notify Cliffs Travel of any unauthorized use of your password or account, or any other breach of security, and that you will log off the Service at the end of each session to prevent unauthorized access.

Conduct Required for Use of the Service

It is a condition of your use of the Service that you do not:

Allow other users to access and use your secure service access and/or password; upload any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable information; engage in disruptive activities or use malicious software including viruses, bots, worms, or other harmful code; upload or transmit any information that violates the rights of others, including intellectual property or privacy rights; post or transmit content that encourages illegal activities; exploit any information from the Service for commercial purposes; attempt to gain unauthorized access to systems connected to the Service; or use the Service for any unlawful purpose.

Cliffs Travel shall determine, in its sole discretion, whether any information transmitted or received violates these provisions. Except as otherwise permitted, you may not decompile, reverse engineer, or otherwise attempt to derive source code from any part of the Service.

Monitoring

Cliffs Travel has no obligation to monitor use of the Service or user activity, but reserves the right to do so at its sole discretion and to take any action deemed appropriate. Cliffs Travel may monitor any information uploaded to the Service and may share such information with affiliated entities. Cliffs Travel also reserves the right to refuse, remove, or alter any information or materials at its discretion and to disclose information as necessary to operate the Service, comply with legal requirements, or protect its users and partners.

How the Service Works

You understand and agree that the Service may include communications such as service announcements and administrative messages, and that these communications are considered part of the Cliffs Travel Service. The Service is provided “AS-IS,” and Cliffs Travel assumes no responsibility for the timeliness, deletion, misdelivery, or failure to store communications or personalization settings.

You are responsible for obtaining access to the Service and providing all necessary equipment. Cliffs Travel will not replace any lost or stolen membership materials, credentials, benefits, or access associated with the Service.

Travel Services

Cliffs Travel makes available to eligible members certain travel products including, but not limited to, hotels, cruises, activities, vacation rentals, and other travel-related services (“Travel Services”). These Travel Services are provided for the personal use of eligible members only.

Cliffs Travel acts solely as a facilitator of Travel Services provided by independent third-party suppliers. Cliffs Travel does not own, operate, or control such suppliers and is not responsible for their acts, errors, omissions, representations, warranties, breaches, or negligence. All Travel Services are subject to the terms and conditions of the applicable third-party provider.

Travel Services may require payment directly to third-party providers at the time of booking and are subject to the applicable cancellation, change, and refund policies displayed at the time of purchase. By proceeding with any booking, you acknowledge and agree to review and accept the applicable third-party terms prior to completing your transaction.

All pricing, availability, savings, and inventory displayed through the Service are subject to change at any time without notice and are not guaranteed until confirmed at the time of booking. Cliffs Travel does not guarantee the availability of any specific rate, inventory, or travel option.

In the event that any booking or transaction cannot be completed, processed, or verified for any reason, the requested Travel Service may not be fulfilled or may be canceled regardless of any confirmation messaging. Cliffs Travel shall not be liable for any failure, delay, cancellation, or inability to fulfill a booking, including in cases where confirmation has been displayed but the transaction cannot be completed or verified.

Account Access; Identity Protection

You are responsible for maintaining the confidentiality of your account and restricting access to your device. If you suspect unauthorized use of your account, you must notify Cliffs Travel immediately and contact your financial institution if applicable.

Cliffs Travel reserves the right to place any account on hold at any time, with or without notification, in order to protect against fraudulent or suspicious activity. Cliffs Travel shall have no obligation to reinstate access or provide compensation for any period during which an account is suspended or restricted due to suspected misuse or fraudulent activity.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the Service for commercial purposes.

Disclaimer of Warranties

Cliffs Travel may provide links to third-party websites or materials. Cliffs Travel does not control these third-party services and is not responsible for their content, accuracy, or availability.

The Service, including all materials, travel content, pricing, and third-party offerings, is provided “AS IS” and without warranties of any kind, whether express or implied. Cliffs Travel does not guarantee that the Service will be uninterrupted, error-free, or free from harmful components, nor does it guarantee the accuracy, completeness, or reliability of any information presented.

You assume full responsibility for your use of the Service and any reliance placed on information obtained through it.

Limitation of Liability

In no event shall Cliffs Travel or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service or any Travel Services, including but not limited to delays, cancellations, pricing discrepancies, supplier failures, or loss of data or revenue, even if advised of the possibility of such damages.

Your use of third-party travel services is at your own risk, and Cliffs Travel shall not be liable for any acts or omissions of such third-party providers.

Some jurisdictions may not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Cliffs Travel and its affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

Termination

Cliffs Travel may, in its sole discretion, terminate or suspend your account or access to the Service at any time without notice for any reason, including violation of these Terms or misuse of the Service.

Cliffs Travel operates as a private, invitation-based platform and reserves the right to approve, deny, suspend, or revoke membership access at any time, with or without cause.

Upon termination, all rights granted to you will immediately cease.

Trademarks

All trademarks, logos, and service marks used within the Cliffs Travel platform are the property of Cliffs Travel or their respective owners and may not be used without permission.

Acceptable Use Policy (AUP)

You agree not to use the Service for unlawful activities, intellectual property violations, harassment, or any activity that compromises security, privacy, or the integrity of the platform. Violations may result in suspension or termination of access.

Special Admonitions for International Use

You agree to comply with all local laws regarding online conduct and acceptable content in your jurisdiction.

Modification to the Terms of Service

Cliffs Travel reserves the right, in its sole discretion, to amend these Terms at any time without notice. Continued use of the Service constitutes your acceptance of any such modifications.

Fair Use Policy (FUP)

The Service, its content, and all associated benefits are intended solely for personal, non-commercial use by the registered member.

Cliffs Travel reserves the right to monitor usage and to restrict, suspend, or revoke access to any Service or benefit if it determines, in its sole discretion, that such use falls outside the intended purpose or violates these Terms.

Consent to Communications

By using the Cliffs Travel Service, you acknowledge and agree that Cliffs Travel and its affiliates may send you communications related to your membership, services, and benefits, including service updates, notifications, and promotional content. You may opt out of non-essential communications at any time.

Benefits

Cliffs Travel may provide access to travel assistance, concierge-style services, vacation rental opportunities, cruise offers, and loyalty-based benefits such as Trip Coins and Room Coins.

Cliffs Travel may also provide access to additional travel-related services including Flight Insurance, Global eSIM connectivity services, and Fast Pass visa and passport assistance. These services are provided through independent third-party partners and are subject to their respective terms, conditions, coverage limitations, availability, and eligibility requirements. Cliffs Travel does not underwrite, administer, or control such services and makes no guarantees regarding coverage, performance, or outcomes.

All benefits and services are subject to availability, eligibility, and change at any time at the sole discretion of Cliffs Travel or its partners. Such benefits are provided for personal use only, have no cash value unless explicitly stated otherwise, and may not be transferred, resold, or redeemed outside of the Cliffs Travel platform. Cliffs Travel is not responsible for any lost, expired, or unused benefits, including but not limited to promotional credits, coins, or access privileges, regardless of cause.

Cliffs Travel does not guarantee the availability, pricing, or fulfillment of any benefit or third-party service.
